Terms of Service

Ophir Intelligence provides AI systems, software engineering, data analytics, and related consulting services, along with a website and client portal. Specific engagements may be governed by a separate written agreement or statement of work, which will control in the event of any conflict with these Terms.

To access certain features you must create an account. You are responsible for the accuracy of your information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use.

You agree not to misuse the Services, including by attempting to gain unauthorized access, interfering with normal operation, uploading unlawful or infringing content, or using the Services to violate any law or the rights of others.

Paid engagements are billed as described in your invoice or statement of work. Invoices are issued and paid through Stripe. Unless stated otherwise, fees are due by the date shown on the invoice and are non-refundable except where required by law or expressly agreed in writing.

The website, its content, and our trademarks and branding are owned by Ophir Intelligence and protected by law. Ownership of deliverables produced under a specific engagement is governed by the applicable agreement or statement of work.

The Services rely on third-party providers (such as Supabase, Stripe, Google, Calendly, and others). Your use of those features may be subject to the providers’ own terms, and we are not responsible for their acts or omissions.

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the maximum extent permitted by law, Ophir Intelligence will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim.

You agree to indemnify and hold Ophir Intelligence harmless from claims and expenses arising out of your misuse of the Services or your violation of these Terms or applicable law.

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Services or other users. Provisions that by their nature should survive termination will do so.

These Terms are governed by the laws of the United States and the state in which Ophir Intelligence is established, without regard to conflict-of-laws principles.

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
